Fentanyl in Bottle Kills Toddler, and Father Is Charged

December 2, 2021 by Injury Law

One night in June, according to court papers, 22-month-old Charles Rosa-Velloso’s father prepared a bottle of formula and gave it to him in the house where they were living at a homeless shelter on Manhattan’s Lower East Side. The next early morning, Charles was discovered face down in bed and covered in vomit. He was soon noticable dead. An analysis of the bottle’s contents by the medical inspector provided the factor: The formula was polluted with fentanyl, according to a criminal complaint submitted on Wednesday. The boy’s body consisted of enough of the drug to kill a grownup. His father, Anthony Rosa, 51, was arraigned Wednesday on charges of second-degree murder, which carries a sentence of as much as 15 years. At the time his son ingested the fentanyl, Mr. Rosa was alone taking care of him in the apartment or condo, at the Urban Household Center shelter on Baruch

Location, because the kid’s mother was at the health center after having provided another kid, the authorities stated. Mr. Rosa informed a detective he made 2 bottles for Charles and saved them in the young boy’s stroller, the grievance states. District attorneys did not state whether

they thought Mr. Rosa– who served about 25 years in prison on drug, weapons and other charges, according to state records– meant to hurt his kid. A second-degree murder charge does not need that the individual causing a death intended physical injury.Mr. Rosa’s attorney at the Legal Help Society declined to comment.Charles’s death, on June 17, was stated a homicide in November after tests were completed. It came amidst a rise in fatal overdoses brought on by fentanyl, an artificial, super-concentrated opioid, throughout the nation, including in New York City.According to the National Center for Health Stats, 106 American children 5 and under died of drug overdoses in 2019, the most recent year for which data is readily available. It was the highest number since the center began tracking such deaths in 1999. In simply the previous couple of months, fentanyl and other opioids have actually been linked to the

deaths of an 11-month-old woman in South Carolina, a 10-month-old in Pennsylvania, a 2-year-old boy in Indiana and a 15-month-old young boy in California. The latest opioid-related fatality of a young child in the city prior to Charles’s death appears to have actually been that of a 1-year-old in the Bronx, Darwin Santana-Gonzalez, who passed away in 2018 after consuming fentanyl and heroin in a home where the drugs were being packaged for sale. The Henry Street Settlement, the nonprofit that runs the shelter where Charles died, stated just that the family no longer lived there. The Department of Homeless Solutions decreased to comment, and the city’s Administration for Kid’s Services said just that it was coordinating with the police. In addition to manslaughter, Mr. Rosa is charged with harassing a caseworker from the children’s services firm who examined him after his son’s death. Mr. Rosa consistently texted hazards to the caseworker, according to the problem, consisting of one that stated,”I can discover anybody in this city, with a Zip code, I discover your zone, next I be right in front of your door.”Ashley Southall contributed reporting.
